Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the CoPack mobile application (the "Service") operated by Klein (Innowarmth) ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Service.

1. Account & Registration

  • Account Options: You may access the Service by registering an account (e.g., via Google or Apple authentication) or by continuing without an account as an anonymous user.
  • Responsibility: You are responsible for safeguarding your account access and device. You agree to take responsibility for all activities or actions that occur under your account or session token.
  • Accuracy: If you choose to register, you agree to provide accurate and complete information.

2. User Content & Conduct

  • Ownership: You retain ownership and all intellectual property rights to any custom packing lists, items, tags, or preferences ("User Content") that you create within the Service.
  • Acceptable Use: You agree that you will not use the Service to create, store, or share content that:
    • Is illegal, defamatory, abusive, harassing, or promotes hate speech.
    • Infringes on any third-party intellectual property, privacy, or publicity rights.
    • Contains malicious code, viruses, or intends to harm or overload the Service infrastructure.
  • Moderation & Removal: We reserve the right, but are not obligated, to monitor, edit, or remove User Content or suspend access if we determine in our sole discretion that a user has violated these Terms.

3. Subscriptions & Payments

  • Billing & Management: Purchases, subscriptions, and renewals are handled directly through the Apple App Store or Google Play Store.
  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours prior to the end of the active billing period via your App Store or Google Play account settings.
  • Refunds: All financial transactions and refund requests are governed by the respective store policies (Apple or Google).

4. Travel Disclaimer & User Responsibility

  • Organizational Tool Only: CoPack is designed strictly as a personal organizational aid and travel checklist tool.
  • Personal Responsibility: You acknowledge and agree that you are solely responsible for verifying all travel rules, personal documentation (including valid passports, visas, and identification), medical prescriptions, customs declarations, tickets, and essential items required for your trips.
  • No Liability for Travel Disruptions: Under no circumstances shall Klein (Innowarmth) be held liable for missed flights, denied border entry, travel delays, extra fees, lost luggage, or any travel disruption resulting from omitted items, sync errors, or your reliance on the Service.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Klein (Innowarmth), its affiliates, directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages—including without limitation, loss of data, loss of goodwill, or other intangible losses—resulting from:

  1. Your access to, or use of, or inability to access or use the Service.
  2. Any unauthorized access, use, or alteration of your transmissions or data.
  3. Any service interruptions or data loss, whether stored locally or on cloud servers.

6. Service Availability & Warranty Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be completely error-free, uninterrupted, or secure at all times.

7. Account Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the jurisdiction of the competent courts of France.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. When updates occur, we will revise the "Last Updated" date and version number at the top of this document. Continued use of the Service after any changes take effect constitutes your acceptance of the new Terms.
